Crazy Transport Question

Italy and Germany are NOT AT WAR with the Soviet union.
Italian units load onto a German Transport. on G3, that transport moves next to a coastal russian territory, no DOW against russia is made.
Russia does it’s turn 3 - NOT AT WAR.
Italians ATTACK! From said Transport on Itlay 3.
Question A: Is this move legal?
Question B: Is Germany automatically at war with Russia? Or if for the purpose of collecting the +5 NO for being at peace, can they stay at peace? - My guess is yes, as it is considered a combat action - as you could SCRAMBLE to defend against the attacking transports - thus it is an ATTACK.

Germany must declare war on USSR before participating in an attack against it.

So in other words… Germany has to declare war on Russia, on Germany’s own turn, before it can allow Italian units to be offloaded and attack Russian Territory?

Yes. Transports that unload for an amphibious assault do so in the Combat movement phase (ending their movement for that turn), and so they are considered part of the combat force.
