I did not want to submerge the sub in sz 91. The US had nothing that could kill it.

The rulebook says that combat ends when all units that can attack or retreat on one or both sides have been destroyed or the attacker retreats. There is also a provision for ending the battle if neither side can fire on the other. None of these conditions were met, therefore combat continues until they are. You have the option of retreating.

I will allow an edit of the turn where you only attack with the fighters and move the transports and carriers in during non-com. You would also have to edit UK’s non-com of an infantry and AA gun to Gibraltar since it is still a hostile territory.
