Vichy defending

Got two questions lately.
Assuming the axis have a mixed fleet of italian and vichy naval units and a british fleet is attacking that sea zone, does UK needs to declare war on Vichy first in order to be able to attack both fleets?
Or is Vichy not defending in that seazone?
My second question is about the Free France capital.
They declared North Algeria as their new capital after French surrender.
In the following turn they loose the capital and establish their new capital in Morocco. Can they receive lend-lease despite the fact that there is no harbour?
And if North Algeria is conquered by UK is Free French allowed to move their capital back to North Algeria again or are they only allowed to move their capital when they loose the territory?

In order to attack both fleets, yes.

In order to attack just the italians, no.

No they can not.

And if North Algeria is conquered by UK is Free French allowed to move their capital back to North Algeria again or are they only allowed to move their capital when they loose the territory?

Do you mean if North Algeria is conquered by the Vichy? In that case FF does not move their capital again. It remains occupied until it is recaptured (then its returned to FF; Although thats a gray area)
