Here’s an example of my question.

On turn 1 Germany attacks Poland.

On turn 2 AH attacks Poland and on Russia’s turn they retreat from Poland.

Now my question is who gets the territory? Germany or AH?

CP’s choice. If they’re being played by different people who can’t agree, I believe it becomes Allies’ (perhaps specifically Russia’s?) choice.
